General Terms and Conditions for the HR FESTIVAL europe – Visitor registration / Ticketing
The ”HR FESTIVAL europe” is an event staged by:
ALMA Medien AG
Hufgasse 17
8008 Zurich
(further referred to as the ‘Organiser’)
The event is organised and hosted by the Organiser, HR Today. The billing is carried out by the Organiser. These General Terms and Conditions (hereafter referred to as the “GTC”) shall apply for the electronic ordering of any types of tickets of the Organiser (hereafter referred to as “Tickets”) on the respective internet website of the event (hereafter referred to as the “website”). The Organiser reserves the right to amend these GTC at any time. The Organiser also reserves the right to use or change the internet website in whole or in part at its discretion and without prior notice. By placing an order, the orderer/purchaser of tickets (hereafter referred to as the “Customer”) accepts these GTC. Any conditions of the Customer differing from these are not valid. Tickets are issued exclusively in digital form or through the print@home process. With print@home, Customers print the tickets at their own convenience, therefore saving time and costs. For this purpose, the Customer only needs a standard, commercially available printer and normal DIN A4 paper. Following a successfully processed order and/or purchase, the Organiser will send the Customer the ticket in PDF form to the e-mail address provided during registration.
1. Contractual parties
The Organiser is also the issuer of the tickets. Thanks to the fact that tickets are ordered or purchased free of charge, contractual relations are exclusively established between the respective Customer and the Organiser.
2. Conclusion of the contract
The overview of the available tickets provided for all sales channels is merely an invitation for the Customer to submit an offer. By ordering the respective ticket type (admission ticket, workshop ticket) in the order mask, by entering his or her e-mail and billing address as well as all necessary data for payment processing and by confirming his or her order by clicking the corresponding buttons, the Customer submits a binding offer to purchase the selected tickets. After an order has been successfully processed (in the case of free tickets) or purchase and on-line payment (TWINT and credit card) has been made, the Customer shall receive a confirmation e-mail from the Organiser. Upon receipt of the confirmation notice, the contract between the Organiser and the Customer is concluded to valid effect. Free tickets will be made available for direct download. In the case of purchase on account, the invoice will be enclosed with the confirmation notice. Tickets for which payment is required will only be made available by download after receipt of payment.
3. Return of tickets for which payment is required / right of cancellation
The Customer acknowledges that there is no right of cancellation of the completed ticket purchase. If the Customer cannot participate in the event, a substitute participant can be designated. An exception applies only to tickets for (a) cancelled or (b) postponed events. In these cases, the original Customer is entitled to a refund of the price paid (does not apply to free tickets). In such a case, tickets do not have to be returned. These are automatically declared invalid. Insofar as the Organiser receives information about cancelled or changed event dates, the Organiser will inform the Customers immediately by e-mail. Any further claims are excluded. If the ticket is lost, the purchase price cannot be reimbursed. If a print@home ticket was not delivered due to an incorrect e-mail address, please contact info@hrfestival.ch. We will contact you immediately and set up delivery to the correct e-mail address.
In the event of non-attendance, there is no entitlement to a refund of the purchase price. In case of non-attendance due to illness, the course fees will be refunded. In this case, however, a written cancellation, including reasons and an appropriate medical certificate, must be submitted to info@hrfestival.ch before the event.
4. Commercial use prohibited
The purchase of tickets for the purpose of resale and the resale itself is prohibited.
5. Payment terms
The total amount including value added tax is payable immediately after the contract is concluded.
If the ticket is not paid within the payment deadline (including extension of the deadline granted by the reminder), the entitlement to participation is forfeited.
6. print@home process
On the date the contract is concluded and payment received, tickets will be sent via e-mail as a PDF file at the Customer’s risk along with the confirmation e-mail. The Customer is obligated to check the PDF documents for correctness and completeness immediately upon receipt (specifically the name of the event, date, time, price and quantity, participant name) and to report any complaints to the Organiser. The ordered ticket (s) in the print@home process are sent directly to the Customer through the printout of the tickets sent electronically to the Customer. The Customer may only make one print copy of each ticket for the purpose of the intended use; he or she is moreover not entitled to reproduce, duplicate or change the printed tickets in any form whatsoever. An unauthorised duplicated or unauthorised resold print@home ticket does not entitle the bearer to attend the event. The bar code and QR code on the document, which can be used only once, will be validated electronically by a scanner at the event venue. This therefore rules out the possibility of additional persons gaining access to the event using the same bar code, for example by copying the bar code. In the event that copies of a print@home ticket should emerge, the Organiser reserves the right to refuse access to the event to holders of copies or holders of unauthorised duplicated print@home tickets. Furthermore, the Organiser reserves the right to demand payment of the total value of the duplicated print@home tickets from the Customer whose ticket had been duplicated without authorization. The Customer who causes loss/damage to a third party through unauthorised duplication or misuse, shall indemnify the Organiser for all claims made against it. The Organiser does not assume any responsibility for the loss and/or misuse of the ticket.
7. At the event venue / on-site at the event
a. Audio, photo and video recordings
During the event, images, audio and video recordings may be made by the organizer or by service providers commissioned by the organizer. In addition to being listed in image galleries and event documentation, these images and videos will be used by the organizer for its own marketing purposes, for example on the Internet, in publications, on social networks and at events organized by the organizer.
By attending an event, the customer agrees to the image, audio and video recordings. The customer expressly allows the organizer to use these for subsequent advertising purposes without any further claims by the customer.
At the event venue (keynotes and workshops), audio and video recordings of more than 1 minute by visitors are prohibited for copyright reasons, unless they are made by persons commissioned by the organizer.
b. Name badge
Tickets are personalised and consist of an information section and a name badge. The name badge serves as the credentials of the visitor on site, entitles admission to the event and must therefore always be visibly worn. The name badge includes the following personal data from the on-line order via the website: Name, surname, position and company name. Another component of the name badge is a bar code / QR code for access authorisation, which is electronically checked and validated by the Organiser at the event venue with a bar code scanner.
8. Guidelines for Handling Customer Data (Privacy Policy)
a) Use of Personal Data in General
The use of personal data, unless specified in this Clause 8, is regulated in the Privacy policy. The Privacy Policy is an integral and binding part of these GTC.
The personal data entered by the customer on this page will be used to contact the customer via email and keep them updated about the event in the future. The organizer informs the customer that their details will also be stored and processed in the organizer’s systems for further processing, such as contract fulfillment (invoicing, payment confirmation, automatic creation of the print@home ticket), and for the event itself (verification and identification of the customer, ticket validation at the event venue) in accordance with privacy regulations. Furthermore, by completing the purchase, the customer agrees that the organizer uses Google Signals.
b) Disclosure to Third Parties
By entering their personal data, customers agree that the information may also be used for marketing purposes by the event organizer and the presenting partners/sponsors.
Contract partners (e.g., exhibitors, sponsors, and partners) will also receive, upon request, the registration data of tickets purchased with their personal code. This information allows them to conduct non-personalized analyses of visitor numbers and use the data for advertising purposes, including targeted outreach to potential customers.
Exhibitors at the event will be offered a lead-tracking service, allowing them to scan the barcode on the entry ticket and obtain contact details similar to a business card. These details include: company name, salutation, title, first and last name, position, address, country, phone numbers, email address, and any additional information provided regarding interests and/or the company.
You can decide on a case-by-case basis whether or not to share your data by offering your entry ticket for scanning by the respective exhibitor.
No further sharing of customer data with third parties will occur.
9. Liability
a) Liability in general
The Organiser is not liable for minor negligence. The same applies to auxiliary persons and substitutes of the Organiser. The Organiser is not liable for errors that are not within its sphere of responsibility, namely for operators of telecommunication services, the hosting provider or other third-party service providers.
b) Amendment of these General Terms and Conditions
For legal and/or organisational reasons, changes or adjustments to these General Terms and Conditions may be necessary. Please refer to the respective current version of our General Terms and Conditions in this regard.
10. Place of jurisdiction and applicable law
The contractual relationship between the Customer and the Organiser is governed by Swiss substantive law, to the exclusion of the Vienna Sales Convention and the applicable conflict of laws. For all disputes arising out of or in connection with this agreement, the Organiser and the Customer agree on the exclusive jurisdiction of the ordinary courts in Zurich (1). In the event of disputes arising from Consumer contracts, the following courts shall have jurisdiction: a) the court at the place of residence or registered office of either the Customer or the Organiser for actions brought by the Customer who qualifies as a consumer; b) the court at the place of residence of the customer for actions brought by the Organiser.
