General Terms and Conditions of Use and Business for HR FESTIVAL europe – Visitor Registration/Ticketing

The “HR FESTIVAL europe” is an event by:

(hereinafter referred to as “Organizer”.)

The event is organized and conducted by the Organizer, HR Today. Invoicing is handled by the Organizer. These General Terms and Conditions of Use and Business (hereinafter referred to as “GTC”) apply to the electronic ordering of all types of tickets from the Organizer (hereinafter referred to as “Tickets”) on the respective event website (hereinafter referred to as “Website”). The Organizer reserves the right to amend these GTC at any time. The Organizer also reserves the right, at its sole discretion and without prior notice, to discontinue or modify the Website in whole or in part. By placing an order, the orderer/buyer of Tickets (hereinafter referred to as “Customer”) fully accepts these GTC. Any differing terms from the Customer are not valid. Tickets are issued exclusively digitally or via the print@home method. With the print@home method, the Customer can conveniently print their ticket themselves, which can save time and costs. The Customer only needs a standard printer and normal DIN A4 paper for this. After a successful order and/or purchase, the Organizer will send the Customer an email with the ticket in PDF format to the email address provided during registration.

1. Contracting Parties

The Organizer is the issuer of the Tickets. By placing a free order or purchasing Tickets, contractual relationships are established exclusively between the respective Customer and the Organizer.

2. Conclusion of Contract

The overview of available Tickets provided across all sales channels serves merely as an invitation for the Customer to make an offer. By ordering the respective ticket type (admission ticket, workshop ticket) in the order form, by entering their email and billing address as well as all necessary payment processing data, and by confirming their order by clicking the corresponding buttons, the Customer submits a binding offer to purchase the selected Tickets. After a successful order (for free Tickets) or purchase on account or online payment (TWINT and credit card), the Customer receives a confirmation email from the Organizer. Upon receipt of the confirmation email, the contract between the Organizer and the Customer is validly concluded. Free Tickets are made available for direct download. For purchases on account, the invoice is attached to the confirmation email. Paid Tickets are only made available for download after payment has been received.

3. Return of Paid Tickets/Right of Withdrawal

The customer acknowledges that there is no right of withdrawal regarding the completed purchase of tickets. If the customer is unable to attend the event, they may provide a substitute participant. An exception applies only to tickets for (a) canceled or (b) rescheduled events. The organizer is not liable for non-performance, delay, or changes arising from circumstances beyond its control (extraordinary, unforeseeable, and/or unavoidable events that cannot be prevented even with the utmost care – e.g., pandemics, official directives, or generally force majeure). In these cases, the original customer is entitled to a refund of the price paid (does not apply to free tickets). In such a case, tickets do not need to be returned; they will be automatically invalidated. If the organizer receives information about canceled or changed event dates, the organizer will promptly inform customers via email. Further claims are excluded. In the event of ticket loss, a refund of the purchase price is not possible. If the print@home ticket was not delivered due to an incorrect email, please contact info@hrfestival.ch. We will contact you immediately and arrange for a resend to the correct email address.

In case of non-attendance, there is no entitlement to a refund of the purchase price. In case of non-attendance due to illness, the course fees will be refunded. For this, however, a written cancellation including justification and a corresponding medical certificate must be submitted to info@hrfestival.ch before the event.

4. Prohibition of Commercial Use

The acquisition of tickets for the purpose of resale, as well as the resale itself, is prohibited.

5. Payment Terms

The total amount, including VAT, is due for immediate payment upon conclusion of the contract.

If the ticket is not paid within the payment deadline (including any extension granted by a reminder), the right to participate will be forfeited.

6. Print@Home Procedure

After the contract is concluded and payment is received, tickets will be sent to the customer via email as a PDF file along with the confirmation email at the time of contract conclusion, at the customer's risk. The customer is obliged to check the PDF documents immediately upon receipt for accuracy and completeness (i.e., especially the name of the event, date, time, price and quantity, name of the participant) and to report any complaints to the organizer. The delivery of the ordered print@home ticket(s) occurs directly by the customer printing the tickets sent electronically. The customer may only produce one printed copy of each ticket for its intended use; otherwise, the customer is not entitled to reproduce, duplicate, or alter the printed tickets in any form whatsoever. An unauthorized duplicated or resold print@home ticket does not entitle the holder to attend the event. The single-use barcode and QR code on the document will be electronically invalidated by a scanner at the event venue. It is therefore impossible for additional persons to gain access to the event with the same barcode, for example, by duplicating the barcode. Should copies of a print@home ticket appear, the organizer reserves the right to deny access to the event to the holders of the copies or the holder of the unauthorized duplicated print@home tickets. Furthermore, the organizer reserves the right to demand payment of the total value of the duplicated print@home tickets from the customer who has unauthorizedly duplicated their ticket. The customer who causes damage to a third party through unauthorized duplication or misuse shall indemnify the organizer against all claims made against them. The organizer bears no responsibility for the loss and/or misuse of the ticket.

7. At the Event Venue/On-site at the Event

a) Audio, Photo, and Video Recordings

During the event, the organizer or service providers commissioned by the organizer may make image, audio, and video recordings. These images and videos will be used by the organizer for their own marketing purposes, including listing in image galleries and event documentation; this includes use on the internet, in publications, on social networks, and at the organizer's events.

By attending an event, the customer agrees to image, audio, and video recordings. The customer expressly permits the organizer to use these for future promotional purposes without any further claims from the customer.

At the event venue (keynotes and workshops), audio and video recordings longer than 1 minute by visitors are prohibited for copyright reasons, unless they are persons commissioned by the organizer.

b) Name Badge

Tickets are personalized and consist of an information section and a name badge. The name badge serves as the customer's on-site identification, grants admission to the event, and must therefore always be worn visibly. The name badge includes the following personal data from the online order via the website: first name, last name, position, and company name. Another component of the name badge is a barcode / QR code for access authorization, which will be electronically checked and invalidated by the organizer using barcode scanners at the event venue.

8. Information on Handling Customer Data (Privacy Policy)

a) The Use of Personal Data in General

The use of personal data, unless otherwise specified in this Section 8, is regulated in the Privacy Policy. The Privacy Policy is an integral and binding part of these General Terms and Conditions.

The personal data entered by the customer on this page will be used to contact the customer via email and keep them informed about the event in the future. The organizer informs the customer that their data will also be stored and processed in the organizer's systems to the extent necessary for further processing, for the purpose of contract execution (invoicing, recording payment receipt, automatic creation of print@home tickets), and for the execution of the event (verification and identification of the customer and invalidation of tickets at the event venue) in accordance with data protection regulations. Furthermore, by completing the purchase, the customer agrees that the organizer uses Google Signals.

b) Disclosure to Third Parties

Customers hereby agree that the personal data entered may also be used for marketing purposes by the organizer and the event's presenting partners/sponsors.

Contract partners (e.g., exhibitors, sponsors, and partners) also receive, upon request, the registration data for tickets obtained with their personal code and/or the registration data of visitors to their sponsored program item. This information allows them, on the one hand, to conduct non-personal analyses of their visitor numbers and, on the other hand, to use the data for their own advertising purposes, including the targeted approach of potential customers.

Furthermore, exhibitors at the fair are offered a lead tracking service, which allows individual exhibitors to scan the barcode on the admission ticket and thus obtain contact details – similar to a business card. These details include: company name, salutation, title, first and last name, position, postal address, country, telephone number(s), email address, and any other information you have provided regarding interests and/or your company.

You can specifically decide on the disclosure of your data in individual cases by offering your admission ticket to the respective exhibitor for scanning.

No other disclosure of customer data to third parties will occur!

9. Liability

a) General Liability

The organizer is not liable for slight negligence. The same applies to the organizer's auxiliary persons and substitutes. The organizer is not liable for errors that are not within their area of responsibility, specifically those of telecommunication service providers, the hosting provider, or other third-party service providers.

b) Amendment of these General Terms and Conditions

Changes or adjustments to these terms and conditions may be necessary for legal and/or organizational reasons. Please refer to the current version of our general terms and conditions in this regard.

10. Place of Jurisdiction and Applicable Law

The contractual relationships between the customer and the organizer are governed by substantive Swiss law, excluding the Vienna Sales Convention and applicable conflict of laws rules. For all disputes arising from or in connection with this agreement, the organizer and the customer agree on the exclusive jurisdiction of the ordinary courts in Zurich (1). In disputes arising from consumer contracts, the following applies: a) for claims by the customer, who qualifies as a consumer, the court at the domicile or registered office of either the customer or the organizer; b) for claims by the organizer, the court at the customer's domicile.
