General Terms and Conditions of Use and Business for the HR FESTIVAL europe - Visitor Registration/Ticketing

The "HR FESTIVAL europe" is an event organized by:

(hereinafter referred to as the "Organizer").

The event is organized and carried out by the organizer, HR Today. Invoices will be issued by the organizer. These General Terms and Conditions of Use and Business (hereinafter referred to as "GTC") apply to the electronic ordering of all types of tickets from the organizer (hereinafter referred to as "tickets") on the respective website of the event (hereinafter referred to as "website"). The Organizer reserves the right to amend these GTC at any time. The Organizer also reserves the right to discontinue or change the Website in whole or in part at its own discretion and without prior notice. By placing an order, the customer/purchaser of tickets (hereinafter referred to as the "Customer") accepts these GTC in full. Any deviating conditions on the part of the customer are not valid. Tickets are created exclusively digitally or using the print@home method. In the print@home process, the customer prints out their ticket themselves, which saves time and money. All the customer needs is a standard printer and normal A4 paper. After a successful order and/or purchase, the organizer sends the customer an e-mail with the ticket in PDF format to the e-mail address provided during registration.

1st contracting parties

The organizer is the issuer of the tickets. Contractual relationships are established exclusively between the respective customer and the organizer through a free order or the purchase of tickets.

2. conclusion of contract

The overview of available tickets provided by all sales channels is merely an invitation to the customer to make an offer. By ordering the respective ticket type (admission ticket, workshop ticket) in the order form, entering their email and billing address as well as all necessary data for payment processing and confirming their order by clicking on the corresponding buttons, the customer submits a binding offer to purchase the selected tickets. After a successful order (for free tickets) or purchase on account or online payment (TWINT and credit card), the customer will receive a confirmation email from the organizer. The contract between the organizer and the customer is validly concluded upon receipt of the confirmation message. Free tickets are made available directly for download. In the case of purchase on account, the invoice will be enclosed with the confirmation notification. Tickets subject to a charge will only be made available for download after receipt of payment.

3. return of chargeable tickets/right of withdrawal

The customer acknowledges that there is no right of withdrawal with regard to the completed purchase of tickets. If the customer is unable to attend the event, he/she may provide a substitute participant. An exception applies only to tickets for (a) canceled or (b) postponed events. In these cases, the original customer is entitled to a refund of the price paid (does not apply to free tickets). In such a case, tickets do not have to be returned. These are automatically declared invalid. If the organizer receives information about canceled or changed event dates, the organizer will inform the customers immediately by e-mail. Further claims are excluded. In the event of loss of the ticket, a refund of the purchase price is not possible. If the print@home ticket was not delivered due to an incorrect e-mail, please contact info@hrfestival.ch. We will contact you immediately and arrange for the ticket to be resent to the correct e-mail address.

In the event of non-attendance, there is no entitlement to a refund of the purchase price. In the event of non-attendance due to illness, the course costs will be refunded. In this case, however, a written cancellation including justification and a corresponding medical certificate must be submitted to info@hrfestival.ch before the event.

4. prohibition of commercial use

The purchase of tickets for the purpose of resale as well as the resale itself is prohibited.

5. terms of payment

The total amount including VAT is due for payment immediately upon conclusion of the contract.

If the ticket is not paid within the payment deadline (including extension of the deadline for the reminder), the entitlement to participate will lapse.

6. print@home process

After conclusion of the contract and receipt of payment, the tickets shall be sent by email as a PDF file together with the confirmation email at the time of conclusion of the contract for the benefit and at the risk of the customer. The customer is obliged to check the PDF documents immediately upon receipt for accuracy and completeness (i.e. in particular the name of the event, date, time, price and number, name of the participant) and to report any complaints to the organizer. The delivery of the ordered ticket(s) in the print@home procedure takes place directly at the customer's premises by printing out the tickets sent electronically to the customer. The customer may only make one printed copy of each ticket for the purpose of using it as intended; the customer is otherwise not entitled to reproduce, duplicate or modify the printed tickets in any form whatsoever. An unauthorized reproduction or unauthorized resale of a print@home ticket does not entitle the holder to attend the event. The single-use barcode and QR code on the document will be electronically validated by a scanner at the event venue. It is therefore impossible for other persons to gain access to the event using the same barcode, e.g. by duplicating the barcode. In the event that copies of a print@home ticket are found, the organizer reserves the right to deny access to the event to the owners of the copies or the owners of the unauthorized duplicated print@home tickets. Furthermore, the organizer reserves the right to demand payment of the total value of the reproduced print@home tickets from the customer who has reproduced their ticket without authorization. The customer who causes damage to a third party through unauthorized duplication or misuse shall indemnify the organizer for all claims made against him. In the event of loss and/or misuse of the ticket, the organizer shall bear no responsibility whatsoever.

7. at the event location/on site at the event

a) Sound, photo and video recordings

During the event, images, audio and video recordings may be made by the organizer or by service providers commissioned by the organizer. In addition to being listed in image galleries and event documentation, these images and videos will be used by the organizer for its own marketing purposes, for example on the internet, in publications, on social networks and at events organized by the organizer.

By attending an event, the customer agrees to the image, sound and video recordings. He expressly allows the organizer to use these for subsequent advertising purposes without any further claims by the customer.

At the event venue (keynotes and workshops), audio and video recordings of more than 1 minute by visitors are prohibited for copyright reasons, unless they are made by persons commissioned by the organizer.

b) Name badge

Tickets are personalized and consist of an information section and a name badge. The name badge serves as identification of the customer on site, authorizes admission to the event and must therefore always be worn visibly. The name badge includes the following personal data from the online order via the website: first name, surname, position and company name. A further component of the name badge is a barcode / QR code for access authorization, which is checked and validated electronically by the organizer at the event venue using a barcode scanner.

8. information on the handling of customer data (privacy policy)

a ) The use of personal data in general

The use of personal data, unless specified in this Section 8, is governed by the Privacy Policy. The privacy policy is an integral and binding part of these GTC.

The personal data entered by the customer on this page will be used to contact the customer by e-mail and to keep him informed about the event in the future. The organizer draws the customer's attention to the fact that his details will also be stored and processed in the organizer's systems to the extent necessary for further processing, for the purpose of contract processing (invoicing, noting receipt of payment, automatic creation of the print@home ticket) and for the execution of the event (checking and identifying the customer and validating the tickets at the event venue) in accordance with the provisions of data protection law. Furthermore, by completing the purchase, the customer agrees that the organizer may use Google Signals.

b) Disclosure to third parties

Customers hereby agree that the personal data entered may also be used for marketing purposes by the organizer and the presenting partners/sponsors of the event.

Contractual partners (e.g. exhibitors, sponsors and partners) will also receive from us, on request, the registration data of the tickets purchased with their personal code. This information enables you to carry out non-personalized analyses of your visitor numbers and to use the data for advertising purposes, including targeting potential customers.

In addition, exhibitors at the trade fair will be offered a lead tracking service that allows individual exhibitors to scan the barcode on their admission ticket and thus receive their contact details - similar to a business card. These are in detail: Company name, salutation, title, first and last name, function, postal address, country, telephone number(s), e-mail address and any other information you may have provided about interests and/or your company.

You can decide on a case-by-case basis whether to pass on your data by offering the respective exhibitor your admission ticket for scanning.

Customer data will not be passed on to third parties in any other way!

9. liability

a) Liability in general

The organizer is not liable for slight negligence. The same applies to auxiliary persons and substitutes of the organizer. The organizer is not liable for errors that are not within its area of responsibility, namely those of telecommunications service providers, the hosting provider or other third-party service providers.

b) Amendment of these General Terms and Conditions

For legal and/or organizational reasons, changes or adjustments to these terms and conditions may be necessary. Please refer to the latest version of our General Terms and Conditions in this regard.

10 Place of jurisdiction and applicable law

The contractual relationship between the Customer and the Organizer shall be governed by substantive Swiss law to the exclusion of the Vienna Sales Convention and the applicable conflict of laws provisions. For all disputes arising from or in connection with this agreement, the organizer and the customer agree to the exclusive jurisdiction of the ordinary courts in Zurich (1). In the event of disputes arising from consumer contracts, the following courts shall have jurisdiction: a) for actions brought by the customer who qualifies as a consumer, the court at the domicile or registered office of either the customer or the organizer; b) for actions brought by the organizer, the court at the customer's domicile.
